People v John Doe-1
In 2009, while working as a door-to-door magazine salesman (the "defendant") was falsely accused of brutally raping (sexual intercourse) a physically handicapped woman in her home, a crime punishable by life in prison. The accuser alleged that she allowed the defendant to enter her home when the defendant told her he was selling magazine subscriptions. After allowing the defendant into her home, the accuser alleged that the defendant closed the door behind him, threw her onto her bed and forcibly rapped her. Seminal fluid belonging to the defendant was recovered from the accusers clothing.
After the alleged attack the defendant's accuser immediatedly went to the hospital where evidence was collected by medical providers and the local police. Based upon a physical description given to the police the defendant was arrested (within an hour of the report to the police), questioned by the police, and charged with one count of criminal sexual conduct in the first degree punishable by life in prison. The defendant was held in custody, unable to post the high bond, pending trial.
There were no witnesses to the alleged charge other than the accuser and the defendant and the defendant asserted that the sex was consensual.
The defendant was represented by attorney Joe Kanan and after a two week jury trial the defendant was found not guilty and released from jail.
This case exemplifies the importance and need for competent and experienced counsel.
